PRIVACY STATEMENT

ARM & Asociados Abogados Y Asesores SL, hereinafter “ARM Abogados”, domiciled at 03730 Jave (Spain), Ctr. del Cap de la Nau 135, and registered under CIF B72474562, is responsible for the processing of personal data. This Privacy Statement shall outline the manner in which such processing is carried out, and shall showcase ARM Abogados’ compliance with the relevant legislation and the rights and obligations disclosed therein.

1. Scope

The regulation (EU) 2016/679 (hereinafter, the “Regulation“) and Organic Law 3/2018 (hereinafter, “LOPDGDD”) establish rules on the protection of natural persons with regard to the processing of your personal data, as well as the protection of your associated fundamental rights and freedoms. In this regard, and in accordance with articles 13 and 14 of the Regulation and article 11 of the LOPDGDD, we inform you of the modalities and purposes with which ARM Abogados, as data controller, will process your personal data. Please read this Privacy Statement carefully before providing us with your personal data or, where appropriate, giving your consent for its processing.

Personal and Special Data

ARM Abogados processes your personal data because you use our services and/or because you provide this information to us yourself.

The Personal Data we may process for the purpose of completion of the professional services under the Service Agreement:

  • First and last name
  • Gender
  • Company name
  • Date of birth
  • Address
  • Phone number
  • Email address
  • Bank account number

Under the relevant legislation, certain data is categorised as Special Data. Such Special Data includes Data relevant to the purpose of uniquely identifying a natural person, such as a Social Security Number.

ARM Abogados processes special categories of data, such as Social Security Numbers (SSNs), only when justified by a legal basis under GDPR Article 9(2). Specifically, SSNs may be processed under the following circumstances:

  • Legal Obligation: Compliance with tax, employment, or financial reporting laws.
  • Contractual Necessity: When required for executing a legal services agreement, including setting up companies, obtaining a NIE, or representing clients in notary proceedings.
  • Explicit Consent: Where no other legal basis applies, we will request explicit written consent.
  • Legal Claims: If required for litigation, defence, or legal proceedings.
  • Legitimate Interest: When necessary for identity verification or fraud prevention, provided that no fundamental rights override this interest.


Automatic Decision-making

ARM Abogados shall not make decisions with significant consequences for individuals based solely on automated processing. This means that decisions are not made by computer programs or systems without human involvement. However, automated processing may be used to execute the Service Agreement between the parties, where deemed necessary. The results of such processing are always discussed with you, the client, and require your signed approval prior to being shared with third parties, such as tax authorities. You have the right to request human review of automated decisions.

4. Storage of Personal Data

ARM Abogados does not retain personal data longer than necessary for the purpose for which it was collected. The retention period for the personal data listed in Articles i. and ii. depend on the duration of the Service Agreement, the use of our services, the nature of the services provided, and whether legal retention periods apply (e.g., tax filings).

In the event that you have given your consent to the processing of your personal data for marketing purposes, your personal data will be kept until you have revoked such authorization, unless the storage of your personal data is necessary for other purposes.

5. Sharing Personal Data with Third Parties

ARM Abogados does not sell your personal data to third parties and shares it only when necessary to fulfil our Service Agreement with you or to comply with legal obligations. We enter into data processing agreements with companies that process your data on our behalf to ensure the same level of security and confidentiality. ARM Abogados remains responsible for these processes.

6. Cookies

ARM Abogados does not use cookies or similar tracking technologies.

Your Rights

Providing your personal data is optional, but if you do not, you will not be able to register with the Sites and/or receive some of the products and services offered through the Sites and/or the information you have requested from us.

You have the right to request access, correction, temporary or permanent restriction, or deletion of your personal data. Additionally, you can withdraw your consent for data processing or object to ARM Abogados processing your data. You also have the right to data portability, meaning you can request us to transfer your data to you or another organisation. This request must not conflict with other legal or contractual obligations.

Requests for access, correction, temporary or permanent restriction, deletion, or data transfer can be sent to info@arm-abogados.com. To verify your identity, please include a copy of your identification document with the request. For privacy protection, black out your photo, MRZ (Machine-readable zone at the bottom of your passport), passport number, and social security number.

We undertake to respond as soon as possible, within (4) four weeks. If deletion of your data conflicts with legal obligations (e.g., mandatory retention periods), we may be required by law to retain certain information.
