PRIVACY STATEMENT

ARM & Asociados Abogados Y Asesores SL, hereinafter "ARM Abogados", located at 03730 Jávea (Spain), Ctr. del Cap de la Nau 135, and registered under CIF B72474562, is responsible for the processing of personal data. This Privacy Statement describes the way such processing is carried out and demonstrates how ARM Abogados complies with the relevant legislation and the rights and obligations set out therein.

Scope

General Data Protection Regulation (EU) 2016/679 (hereinafter "the Regulation") and Ley Orgánica 3/2018 (hereinafter "LOPDGDD") establish rules to protect natural persons with regard to the processing of their personal data, as well as to protect their fundamental rights and freedoms. In this context, and in accordance with Articles 13 and 14 of the Regulation and Article 11 of the LOPDGDD, we inform you of the modalities and purposes by which ARM Abogados, as a controller, processes your personal data. Please read this Privacy Notice carefully before you provide us with your personal data or, where applicable, consent to its processing.

Personal and Special Data

ARM Abogados processes your personal data because you use our services and/or because you provide this information to us yourself.

The personal data we may process for the performance of professional services under the Services Agreement include:

• First name and surname
• Gender
• Company name
• Date of birth
• Address
• Phone number
• Email address
• Bank account number

Under applicable law, certain data is classified as Special Data. Such Special Data include data relevant to the unique identification of a natural person, such as a Citizen Service Number (BSN).

ARM Abogados processes special categories of data, such as BSNs, only when justified on a legal basis under Article 9(2) of the Regulation. Specifically, BSNs may be processed under the following circumstances:

• Legal obligation: To comply with tax, labour or financial reporting obligations.
• Contractual necessity: When required for the performance of a legal services agreement, such as setting up companies, obtaining an NIE or representing clients in notarial proceedings.
• Express consent: Where no other legal basis applies, we ask for express written consent.
• Legal claims: If required for legal proceedings, defence or dispute resolution.
• Justified interest: When necessary for identity verification or fraud prevention, provided this interest is not overridden by fundamental rights.

Automated decision-making

ARM Abogados does not make decisions with a significant impact on individuals based solely on automated processing. This means that decisions are not made by computer systems without human intervention. However, automated processing may be used for the performance of the Service Agreement between the parties, if necessary. The results are always discussed with you and require your written approval before being shared with third parties, such as the tax authorities. You have the right to request human review of automated decisions.

Retention of personal data

ARM Abogados does not retain your personal data for longer than necessary for the purpose for which it was collected. The retention period of the personal data mentioned in articles i and ii depends on the duration of the Service Agreement, the use of our services, the nature of the services provided and applicable legal retention periods (e.g. for tax returns).

If you have consented to the processing of your personal data for marketing purposes, your data will be retained until you withdraw this consent, unless retention is necessary for other purposes.

Sharing personal data with third parties

ARM Abogados does not sell your personal data to third parties and only shares it when necessary for the execution of our Service Agreement or to comply with legal obligations. We conclude processing agreements with companies that process your data on our behalf to ensure the same level of security and confidentiality. ARM Abogados remains responsible for this processing.

Cookies

ARM Abogados does not use cookies or similar tracking technologies.

Your rights

Providing your personal data is optional, but if you do not do so, registration on our websites and/or receiving certain products and services may not be available.

You have the right to request access, correction, temporary or permanent restriction or deletion of your personal data. In addition, you may withdraw your consent to data processing or object to processing by ARM Abogados. You also have the right to data portability, which means that you can request us to transfer your data to yourself or another organisation, provided this request does not conflict with other legal or contractual obligations.

Requests for access, correction, restriction, deletion or transfer can be sent to info@arm-abogados.com. To verify your identity, please enclose a copy of your identity document. For privacy protection, we recommend masking your photo, MRZ (Machine-Readable Zone at the bottom of your passport), passport number and BSN.

We will respond to your request as soon as possible, within (4) four weeks. If deletion of your data conflicts with legal obligations (e.g. mandatory retention periods), we may be obliged to retain certain data.
